By an interim order of 6 November 2020, the administrative judge, applied to on behalf of TELT (Tunnel Euralpin Lyon-Turin), suspended the municipal decree which prohibited the circulation of trucks to and from the construction sites in the strategic sector of Bourget-Villarodin in Savoie (south-east France).
The judge thus accepts the conclusions that this police measure was manifestly disproportionate and excessively infringed freedom of movement and freedom of enterprise. The municipal decree was also illegal with regard to the Lyon-Turin tunnel's declarations of public utility, and the bilateral agreements between France and Italy.
