Gide assisted, from July 2013 to April 2016, the Mining Rights and Agreements Technical Review Committee (Comité Technique de Revue des Titres et Conventions Miniers, CTRTCM), a technical body of the National Mining Commission of the Republic of Guinea, on the review of the mining rights and agreements issued or entered into before the enactment of the new Mining Code of Guinea, which was adopted in 2011 and amended in 2013.
This review aimed to analyse, from a legal, technical and financial point of view, all the mining rights and agreements pertaining to 19 mining projects (bauxite, ore and gold) in Guinea to (i) check their compliance with the law applicable at the time of their signing or issue; (ii) analyse the economic and technical basics of the relevant projects; and (iii) depending on the results of these analyses, to negotiate their adaptation and ensure their compliance with the provisions of the new Mining Code, pursuant to its transitional provisions.
As well as increasing its income through application of the provisions of the new Mining Code, the State thus also managed to enhance the rules applicable to these projects, particularly as regards corruption, environment, governance and social aspects. The review was conducted with the financial support of the African Development Bank (AfDB) and the African Legal Support Facility (ALSF).
