Rio 2016 Olympic Games | International Arbitration
The Court of Arbitration for Sport (CAS) announced on 26 July 2016 it has opened two temporary divisions on the site of the Rio 2016 Olympic Games in order to resolve legal disputes and doping cases. They will operate every day until they close on Sunday 21 August 2016.
For the first time in the history of the Olympic Games, the CAS will be in charge of doping-related matters arising on the occasion of the Games as a first-instance authority. This new structure will handle potential doping cases referred to it in accordance with the IOC Anti-doping Rules. The CAS Anti-doping Division will adjudicate on these cases after hearing the parties concerned. It may also impose provisional suspensions pending the conclusion of the procedure. Final decisions rendered by the CAS Anti-doping Division may be appealed before the CAS ad hoc Division in Rio or before the CAS in Lausanne after the end of the Olympic Games.
Carole Malinvaud, a Gide partner specialising in international arbitration, will chair the CAS Anti-doping Division of the Rio 2016 Olympic Games.
Carole co-heads Gide's International Arbitration practice group, where she practises as counsel or arbitrator in a number of ad hoc and institutional arbitration cases. Admitted to the New York and Paris Bars, Carole is a former chair of the Comité Français de l'Arbitrage (CFA). She chairs the International Chamber of Commerce French international arbitration commission (ICC France) and is an elected member of the International Council of Arbitration for Sport (ICAS). Carole is also chair of the Gide Pro Bono endowment fund.
The Presidents and arbitrators for each division were selected by the ICAS, an independent body, under the aegis of which the CAS operates. They are all either lawyers, judges or professors specialised in sports law and/or arbitration and are independent of the parties who appear before the CAS.
