On 5 August 2013, the judge of pre-contractual emergency proceedings at the Paris civil Court (Tribunal de grande instance de Paris) rendered its decision on a case regarding the regularity of conditions in awarding the contract for the provision of catering services on board trains (whose amount is estimated at approx. 900 million euros). The decision ruled that the French national railway company (SNCF), the contracting entity that brought the consultation, had not in any way failed to fulfil its obligations in terms of advertising and competitive bidding (call for tenders).
The judge then dismissed all claims brought by the current catering service provider Cremonini.
Gide Loyrette Nouel represented the SNCF with a team comprising partner Laurent Deruy, assisted by Lila Zarfaoui-Duval (Public Law) and Audrey Kukulski (Dispute Resolution).
