Due to the expiry of the term of duty of three members of the Turkish Competition Board (the "TCB") on 24 June 2019, the TCB has not been able to fulfil required meeting and decision quora for certain decisions since that date. This problem was solved on 2 November 2019 with two appointments made directly by decision of the President of the Republic of Turkey, as published in the Official Gazette no. 30936.
In this decision, the former president of the TCB, Mr Ömer Torlak, was replaced by Mr Birol Küle, former member of the Turkish Capital Markets Board, and the former second president of the TCB, Mr Arslan Narin, was re-appointed. Although there is still one empty seat, the above appointments mean the TCB is again fully operative and can accordingly adopt final decisions (e.g. decisions not to launch investigations) that require the attendance of at least five members and the positive vote of at least four members.
Several pending cases that were awaiting the TCB's decision following a preliminary investigation phase are now expected to be finalised soon. Similarly, oral hearings that had been postponed since June 2019 are likely to be scheduled in the near future.
