In its judgement rendered on 7 February 2014, the Gap Tribunal de Grande Instance (TGI) granted the forms of order sought by SEMLORE (local public-private joint venture chaired by Mr Paul Dijoud and set up by the Caisse des Dépôts et Consignations and the town of Orres), the operator of the Orres winter and summer sports resort which had been the backdrop to a fatal downhill mountain biking accident in 2009 on a slope that was maintained by SEMLORE as part of its public service delegation programme.
After the charges were dropped, the preliminary research did not reveal any offence, the competent civil court ruling that the mountain biking slope operator was not in breach of any safety requirements. The victim’s beneficiaries’ and their insurer’s claim for compensation (approx. EUR 1 million) was dismissed.
