26 November 2012: Qualification of street furniture contracts: Gide Loyrette Nouel on the judgment rendered by the Paris Administrative Court of Appeal
In a judgment rendered by plenary assembly on 17 October 2012, the Paris Administrative Court of Appeal stated that the contract for the installation and operation of revolving display columns and poster-supporting poles of the City of Paris (Ville de Paris), entered into with JC Decaux as a public lands occupancy agreement, was a public procurement contract in nature. The Court stated that the purpose of this contract was, other than authorising the occupancy of the land, to enable the creation and supply of services to the City of Paris for the promotion of cultural activities. The Court therefore upheld the findings of CBS Outdoor in directing the City of Paris to terminate its contract with JC Decaux within a maximum period of eight months.
