4 July 2012 : Gide advises PMU and Equidia: French broadcasting authority CSA dismisses Parabole Réunion's application for dispute resolution
On 22 May 2012, the French broadcasting authority (CSA) dismissed satellite operator Parabole Réunion's application for dispute resolution following the refusal of Equidia SAS and GIE PMU to renew the broadcasting contract for channel Equidia Live.
Pursuant to article 17-1 of the Law of 30 September 1986 on the freedom of communication, the CSA does indeed hold jurisdiction to settle disputes between content publishers and broadcasters. In this particular case, the CSA considered that the decision made by Equidia SAS and PMU to end their relationship with Parabole Réunion and to conclude an exclusive distribution contract with Canal+ Réunion was valid.
Gide Loyrette Nouel partner Olivier Cousi and associates Stéphanie Berland-Basnier and Judith Lavédrine assisted Equidia SAS and PMU.
Cyril Bourayne of Dizier&Bourayne advised Parabole Réunion.
Wilhelm&Associés partners Pascal Wilhelm and Edouard Bloch assisted Canal+ Réunion.
