Gide, counsel to TELT (Tunnel Euralpin Lyon-Turin), obtains a suspension of the municipal bye-law that prohibited access to construction sites in Savoie
The judge thus accepts the conclusions that this police measure was manifestly disproportionate and excessively infringed freedom of movement and freedom of enterprise. The municipal decree was also illegal with regard to the Lyon-Turin tunnel’s declarations of public utility, and the bilateral agreements between France and Italy.
