Intellectual Property

Intellectual property is a strategic issue for innovative and creative companies, which must protect and leverage their intangible assets in a constantly evolving competitive and regulatory environment. We support you in all areas of intellectual property, both in advisory and litigation, in France and internationally.
Our intellectual property team is one of the largest and most recognised in the French market, offering a comprehensive and tailored approach to your intellectual property challenges.

It is one of the few teams in the French market with such a well-established practice across all areas of intellectual property (patents, trademarks, designs and models, copyright and related rights, know-how, and trade secrets).

Our lawyers work in both litigation and advisory roles and are recognised for their ability to design complex strategies, including in international contexts.

We advise you on the creation, exploitation, and protection of your intellectual property rights, as well as the negotiation and drafting of related contracts.

We have developed top-tier expertise in intellectual property litigation, including in cross-border patent and trademark cases.

Our teams are well-equipped to argue cases before the Unified Patent Court, with the ability to plead in both French and English.

We have a long-standing partnership with industrial property advisors from specialist intellectual property law firm Regimbeau firm, a firm with which we have collaborated for over 30 years. This allows us to leverage a wide range of technical expertise, with experienced patent litigation lawyers, and involve a sufficiently large team to respond effectively to the time constraints and workload involved in such cases.

We also have some of the most in-depth expertise in France for trade mark and design disputes before all the intellectual property courts and offices in France and the European Union.

Furthermore, our team is highly regarded for its work in matters of copyright and related rights (litigation, contracts, and strategic negotiations; relations with major platforms), particularly in the media and entertainment, innovation, luxury, gaming, art, architecture, and events sectors.

We offer you a comprehensive and tailored approach to your transactional intellectual property matters, in close collaboration with all the other specialists at Gide.

Areas of intervention

  • We act in litigation before national courts and the Unified Patent Court (UPC) and have expertise in multi-jurisdictional strategies.

  • We support our clients in the protection and development of their trademarks and designs. We develop pre-launch strategies for new products to manage risks and prevent the launch of competing products which infringe their rights. We help our clients to draft and negotiate contracts to commercialise these rights (assignments, licences, co-ownership, co-existence, etc.)

  • We assist our clients in the drafting and negotiation of all contracts related to the valuation of intellectual property rights (assignments, licenses, co-ownership, coexistence agreements, research and development contracts, etc.), as well as in managing intellectual property aspects in all major operations (acquisitions, IPOs, joint ventures, industrial projects, etc.).

  • We help our clients to define and implement a strategy for protecting and enhancing the value of their trademarks, in France and abroad, by filing applications with the various offices and coordinating customs anti-counterfeiting measures.

  • We help our clients to protect, commercialise and defend their copyright and neighbouring rights, by means of assignments, licences, co-production and distribution agreements, and in strategic negotiations and litigation.

  • We advise and defend our clients in disputes related to domain names, online arbitration, trademark infringement, or copyright violations on the internet. We also assist in the creation of websites, the transfer of domain name rights, and the use of copyright and trademark rights online.
